User Agreement (Terms of Use)

This User Agreement ("Agreement") governs your access to and use of the website, services, communications, and systems operated by Visionary Surplus Recovery LLC ("VSR," "we," "us," or "our"), including our Equity Claims Department (collectively, the "Service"). By accessing or using the Service, you agree to be bound by this Agreement. If you do not agree, you may not use the Service.

I. Introduction

Visionary Surplus Recovery begins every new user relationship with a clear contractual agreement. This Agreement explains what you can expect from us and what we expect from you. Because we do not know each user personally, these terms establish the ground rules governing the use of our Service.

If you have questions about any part of this Agreement, please contact us. We are happy to explain why these provisions are important to our process. Until an agreement is in place, you will not receive Services from Visionary Surplus Recovery.

In this Agreement, we refer to Visionary Surplus Recovery LLC as the "Company" or "VSR," the individual accessing or using the Service as the "User," and this document as the "Agreement."

II. Nature of the Relationship

Visionary Surplus Recovery is an asset and equity recovery firm that assists former property owners, heirs, and estates with identifying and pursuing foreclosure surplus funds and related equity matters. VSR does not guarantee eligibility, recovery, timing, or outcomes. Results depend on government processes, competing claims, documentation, and legal factors outside our control.

No Attorney-Client Relationship

Use of the Service does not create an attorney-client relationship between you and Visionary Surplus Recovery or any attorney we may work with. Communications with VSR are not privileged legal communications.

No Legal Advice

Visionary Surplus Recovery is not a law firm and does not provide legal advice, legal opinions, or legal representation. Any information provided is for general informational purposes only.

III. Confidentiality & User Submissions

We make reasonable efforts to protect information submitted through our systems; however, we cannot guarantee absolute confidentiality due to technical limitations, third-party services, or unauthorized access.

You agree:

  • Not to submit false, misleading, or unlawful information

  • Not to submit sensitive personal admissions beyond what is necessary for claim evaluation

  • That information submitted may be shared with third parties (such as attorneys, title companies, or government agencies) as required to perform Services

VSR is not responsible for misuse or disclosure of information caused by factors beyond our reasonable control.

IV. Indemnification

You agree to indemnify, defend, and hold harmless Visionary Surplus Recovery LLC, its owners, officers, employees, contractors, affiliates, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including attorneys’ fees) arising from:

  • Your use of the Service

  • Your violation of this Agreement

  • Your submission of inaccurate or unauthorized information

  • Your violation of any applicable law or third-party rights

VSR reserves the right to assume exclusive defense and control of any matter subject to indemnification.

V. Communications & Data Integrity

We do not guarantee uninterrupted access to the Service. You acknowledge that data loss may occur due to system outages, third-party failures, or other events. VSR is not liable for loss or corruption of data.

VI. Communications, SMS & Consent

By providing your phone number or email address, you consent to receive informational and transactional communications related to your inquiry, claim, or Services requested. Message frequency varies. Msg & data rates may apply. You may opt out of SMS messages at any time by replying STOP.

Consent to receive communications is not a condition of purchase.

VII. Company Rights & Termination

Visionary Surplus Recovery reserves the right to:

  • Deny or terminate Service at any time, with or without cause

  • Suspend accounts for suspected violations of this Agreement or applicable law

  • Disclose user information as permitted by the Privacy Policy or required by law

VIII. Modifications to This Agreement

We may update this Agreement at any time. Updates will be posted on our website. Continued use of the Service after changes take effect constitutes acceptance of the revised Agreement.

IX. Intellectual Property

All content, design, text, graphics, logos, software, and materials within the Service are owned by or licensed to Visionary Surplus Recovery and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without written permission.

X. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. VSR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or result in successful recovery of surplus funds.

XI. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISIONARY SURPLUS RECOVERY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

XII. Arbitration & Governing Law

Any dispute arising out of or relating to this Agreement or the Service shall be resolved by binding arbitration under the rules of the American Arbitration Association. Arbitration shall take place in Pinellas County, Florida.

This Agreement shall be governed by the laws of the State of Florida, without regard to conflict of law principles.

XIII. General Provisions

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and Visionary Surplus Recovery. If any provision is found unenforceable, the remaining provisions shall remain in effect.

Any claim must be brought within one (1) year of accrual.
